01 The “Regulations on Guaranteeing Payments for Small and Medium-sized Enterprises” are implemented!
Premier Li Keqiang signed an order of the State Council to promulgate the “Regulations on Guaranteeing Payments for Small and Medium-sized Enterprises”, which will come into effect on September 1, 2020. The “Regulations” clarify that agencies and institutions purchasing goods, projects, and services from small and medium-sized enterprises shall pay within 30 days from the date of delivery of the goods, projects, and services; if the contract otherwise stipulates, the maximum payment period shall not exceed 60 days. Government agencies, institutions and large enterprises shall pay overdue interest if they delay making payments to SMEs. If the circumstances of arrears are serious, the complaint-accepting department may incorporate its untrustworthy information into the national credit information sharing platform in accordance with laws and regulations, and publicize it to the public through the corporate credit information publicity system, and implement untrustworthy punishments in accordance with the law.
02 A qualification certification system is implemented for the recycling and dismantling of scrapped motor vehicles!
Seven departments including the Ministry of Commerce, the Development and Reform Commission, and the Ministry of Industry and Information Technology jointly issued the “Detailed Rules for the Implementation of the Measures for the Recycling of Scrapped Motor Vehicles”, which will be implemented on September 1, 2020. The “Detailed Rules” pointed out that the state implements a qualification certification system for recycling and dismantling enterprises. Without qualification certification, no unit or individual may engage in the recycling and dismantling of scrapped motor vehicles. In addition, the “Rules” clearly stipulate the “Code of Conduct for Recycling and Dismantling” and “Code of Conduct for Recycling”.
03 Eight types of medicines including health medicines are no longer included in the scope of medical insurance reimbursement!
The National Medical Insurance Administration issued the “Interim Measures for the Administration of Medications for Basic Medical Insurance”, which will come into effect on September 1, 2020. The Ministry of Industry and Information Technology issued the newly revised “Regulations on the Access Management of New Energy Automobile Manufacturers and Products”, which will be implemented on September 1, 2020. The “Regulations” clarify that new energy vehicle manufacturers should establish a file for each new energy vehicle product throughout the product life cycle, track and record the use, maintenance, and repair of the vehicle, and implement the traceability information management of the new energy vehicle power battery. Record the recycling of power batteries. In addition, the new version of the “Regulations” deletes the “design and development capabilities” requirements for applying for the entry of new energy vehicle manufacturers, lowering the entry threshold for enterprises; adjusting the time for new energy vehicle manufacturers to stop production from 12 months to 24 months; Delete the temporary provision for the transition period for new energy vehicle manufacturers to apply for access.
07 Implementation of “National Chemical Fertilizer Commercial Reserve Management Measures”!
The National Development and Reform Commission and the Ministry of Finance jointly issued the “Management Measures for the National Fertilizer Commercial Reserve”, which will be implemented on September 1, 2020. The “Measures” clarify that the national chemical fertilizer commercial reserve is divided into three parts: potash fertilizer reserve, disaster relief fertilizer reserve, and spring fertilizer reserve. The total size of the reserve takes into account the domestic fertilizer production and demand and the import and export situation, and will be dynamically adjusted after the end of each storage responsibility period. . The national chemical fertilizer commercial reserve task is voluntarily undertaken by the enterprise and is responsible for its own profits and losses. The required funds can be solved by applying for loans from the Agricultural Development Bank of China, etc., and the central government will provide financial subsidies. During the annual reserve period, in case of special circumstances such as macro-control needs or major natural disasters, the state can designate relevant enterprises to exercise preemptive rights to reserve chemical fertilizers.
08 The implementation of resource tax related issues has changed!
The Ministry of Finance and the State Administration of Taxation jointly issued the “Announcement on the Implementation of Resource Tax Issues”, which will come into effect on September 1, 2020. The “Announcement” clarified that the sales of taxable products under resource tax shall be determined based on the entire price collected by the taxpayer from the purchaser for the sale of taxable products, excluding value-added tax. The related transportation and miscellaneous expenses included in the sales are allowed to be deducted from the sales if the value-added tax invoice or other legal and valid evidence is obtained. Where a taxpayer purchases a taxable product and sells it together with a self-purchased taxable product or mixes it into a taxable product for sale, the taxable product sales or sales volume may be deducted or deducted when calculating the taxable product sales or sales volume. Purchase quantity; if there is insufficient deduction in the current period, the deduction can be carried forward to the next period.
09 Do not dispose, bury, or burn agricultural film at will
Four departments including the Ministry of Agriculture and Rural Affairs and the Ministry of Industry and Information Technology jointly issued the “Agricultural Film Management Measures”, which will be implemented on September 1, 2020. The “Measures” clearly prohibit the production, sale, and use of agricultural films that are explicitly prohibited by the state or that do not meet compulsory national standards. Encourage and support the production and use of fully biodegradable agricultural films. The users of agricultural film shall pick up the non-fully biodegradable agricultural film waste in the field before the expiration of the use period, and deliver it to the recycling network or recycling workers, and shall not dispose of, bury or incinerate at will. Agricultural film producers, sellers, recycling outlets, waste agricultural film recycling enterprises or other organizations should establish a sound agricultural film recycling system to promote the recovery, treatment and reuse of waste agricultural film.
